According to Decree 86/2014/ND-CP on business and conditions for doing business in transportation by automobiles, from July 1, 2018, trucks with a designed tonnage of under 3.5 tons involved in cargo transportation business activities needed to comply with some new regulations. Among them, whether or not trucks under 3.5 tons must attach truck badges was one of the most concerning issues for many vehicle owners.

Mr. Nguyen Tuan Duong, an owner of a 1.5-ton truck in Hanoi, shared: “I was quite surprised to hear about the 2018 truck badge regulation for vehicles under 3.5 tons. If this is a mandatory regulation, I will definitely comply. However, I’m still not sure if my vehicle really needs a badge because I only transport goods for my family, not professional transportation business.”

He said that at that time, the Hanoi Department of Transport had received many applications for truck badges, showing that people had begun to pay attention to this regulation. However, many vehicle owners still did not fully understand the procedures and necessary documents for applying for badges.

The application for a truck badge according to regulations includes:

  • A copy of the vehicle registration certificate (still valid).
  • A copy of the vehicle inspection certificate (still valid).
  • Documents proving that the vehicle has been installed with a standard travel monitoring device (GSHT) and transmits data to the Vietnam Road Administration.

Mr. Long also emphasized that the installation of travel monitoring devices is mandatory for transportation business vehicles to ensure effective management and monitoring of transportation activities.

The Purpose of Attaching Truck Badges According to the 2018 Regulations

Mr. Nguyen Van Thanh, Chairman of the Vietnam Automobile Transportation Association, said that the issuance of badges and license plates in the transportation business has been implemented for a long time and has brought many positive effects.

According to Mr. Thanh, the main objectives of the 2018 truck badge regulation are:

  • Vehicle management: Helping authorities easily identify which enterprise, cooperative, or business household a vehicle belongs to, facilitating management and inspection work.
  • Transportation business management: Serving as a basis for managing the number of vehicles of transportation business units, ensuring professionalism and order in transportation activities.
  • Traffic organization: Serving the work of traffic organization, traffic flow distribution on routes with limited vehicles, especially in urban areas.
  • Travel monitoring: GSHT devices help monitor the travel, speed, and driving time of drivers, contributing to improving traffic safety and reducing accidents.

Which Trucks Are Required to Have Badges According to the 2018 Regulations?

One of the most confusing points of the 2018 truck badge regulation is determining which vehicles actually need to have badges. Mr. Dao Viet Long explained this issue in more detail:

According to Clause 1, Article 50, Circular 63/2014/TT-BGTVT, units doing cargo transportation business without direct payment (for example: transporting internal goods from the factory to the warehouse) using vehicles under 10 tons and with a number of fewer than 5 vehicles are not subject to the issuance of permits for doing business in transportation by automobiles, truck badges, and installation of travel monitoring devices.

Thus, trucks under 3.5 tons that are not in the transportation business (carrying goods for families, individuals, internal enterprises not doing transportation business) are not required to attach truck badges and install GSHT devices.

However, Ms. Phan Thi Thu Hien, Deputy Director-General of the Vietnam Road Administration, also emphasized that, according to Decree 86/2014/ND-CP, there are two forms of transportation business by automobiles:

  • Transportation business with direct payment: This is a form of cargo or passenger transportation in which the transportation unit directly collects money from customers or cargo owners.
  • Transportation business without direct payment: This form includes units using automobiles to transport goods serving the production and business activities of their own units, not directly collecting freight charges.

For units doing transportation business without direct payment that must be granted a permit for doing business in transportation, badges, and installation of GSHT devices, including the following cases (according to Clause 1, Article 50 of Circular 63/2014/TT-BGTVT):

  • Using vehicles to transport dangerous goods.
  • Using vehicles to transport oversized and overweight goods.
  • Having 5 or more trucks.
  • Using vehicles with a permissible carrying capacity for participating in traffic of 10 tons or more to transport goods.

From the above regulations, it is clear that most trucks under 3.5 tons of households and individuals used for personal cargo purposes, not doing transportation business, will not be subject to mandatory attachment of the 2018 truck badge.

Sanctions for Non-Compliance with the 2018 Truck Badge Regulations

Ms. Phan Thi Thu Hien also noted that, according to the roadmap of Decree 86, from July 1, 2018, transportation business vehicles from 3.5 tons or less must install travel monitoring devices. After this time, enterprises, cooperatives, business households doing cargo transportation, and drivers of cargo transportation business automobiles with a tonnage of under 3.5 tons who do not comply with regulations will be subject to administrative sanctions according to Decree 46/2016/ND-CP with a fine of 3 to 5 million VND.
