When delivering and returning the vehicle, both parties will jointly inspect the condition of the vehicle, comparing it with the vehicle handover record (if any). If any damage occurs during the rental period, both parties will make a record and agree on a solution.

Article 6: Rights and Obligations of the Lessor (Party A)

Obligations of Party A:

a) Deliver the truck to Party B on time, at the location, and in the condition as agreed in the Agreement. Ensure the vehicle is in good working order and has full legal documents.

b) Perform periodic maintenance and servicing to ensure the vehicle’s usability throughout the rental period (if agreed).

c) Ensure Party B’s right to use the truck during the rental period.
Rights of Party A:

a) Receive full truck rental payments according to the agreed method and schedule.

b) Retake possession of the truck upon expiration of the Agreement or when Party B violates the agreement.

c) Unilaterally terminate the Agreement and demand compensation for damages if Party B violates one of the following clauses:
- Failure to pay the rental fee for ……. consecutive months.
- Using the truck for purposes other than those agreed upon.
- Causing serious damage to the truck or losing the truck.
- Arbitrarily repairing, altering the vehicle’s structure, or subleasing the truck without the consent of Party A.
- Violating the law when using the rented truck.

Article 7: Rights and Obligations of the Lessee (Party B)

Obligations of Party B:

a) Take care of the truck as if it were their own property, not arbitrarily changing the condition of the vehicle, and not subleasing the truck without the written consent of Party A.

b) Use the truck for the purpose and within the scope of operation agreed upon.

c) Pay the truck rental fee in full and on time.

d) Return the truck to Party A on time, at the location, and in the condition as when received (with natural wear and tear).

e) Bear all vehicle operating costs during the rental period (e.g., fuel, toll fees, parking fees, minor repair costs arising from normal wear and tear).

f) During the rental period, if Party B causes an accident or damage to the vehicle (not due to natural wear and tear), Party B must immediately notify Party A and be responsible for repairing, overcoming the consequences, and compensating for damages (if any).
Rights of Party B:

a) Receive the truck as agreed in the Agreement.

b) Be entitled to use the truck for the purpose and within the scope of operation agreed upon.

c) Unilaterally terminate the Agreement and demand compensation for damages if:
- Party A delivers the truck late compared to the agreed time, causing damage to Party B.
- Party A delivers a truck that does not meet the characteristics and condition as described in Article 1 of the Agreement.
- The rented truck experiences a serious technical problem that cannot be resolved, affecting Party B’s use of the truck.

Article 8: Guarantee Clauses

Party A guarantees:
- The information about personal details and the truck mentioned above is completely true.
- The truck is free from disputes and is not bound by any other transactions.
- The signing of this Agreement is completely voluntary, without coercion or deception.
- Fully and properly implement the agreements in the Agreement.
Party B guarantees:
- Personal information is true.
- Has carefully checked the condition of the truck and agreed to rent it.
- The signing of this Agreement is completely voluntary, without coercion or deception.
- Fully and properly implement the agreements in the Agreement.
Both parties guarantee:
- The provided documents are genuine, legal, and still valid.
- Be responsible before the law for their commitments.
- At the time of signing the Agreement, both parties are of sound mind and have full civil act capacity.

Article 9: General Terms and Enforcement Clauses

Termination of the Agreement before the term: If either party wants to terminate the Agreement before the term due to force majeure, they must notify the other party in writing ……. days in advance. The violating party must be responsible for compensating for damages in accordance with the provisions of law (if any).
Extension of the Agreement: ……. days before the Agreement expires, both parties will discuss the liquidation of the Agreement. If there is a need to continue renting the truck, both parties will sign a new contract or an addendum to extend the contract.
