Business Registration Requirements for Freight Transport
Article 14 of Decree 10/2020/ND-CP clearly stipulates the business conditions for freight transport by car:
- Legal Ownership or Use Rights: The vehicle must be under the legal ownership or use rights of the freight transport business unit through a written vehicle lease contract with an organization or individual, or a business cooperation contract as prescribed. In cases where the vehicle is registered under the ownership of a cooperative member, there must be a service contract between the member and the cooperative, clearly defining the rights, responsibilities, and obligations for managing, using, and operating the vehicle.
- Installation of Surveillance Cameras (Applicable to container trucks and tractor-trailers before July 1, 2021): Vehicles must be equipped with cameras to record and store images of the driver during traffic participation. Image data must be provided to the Police Authority, Traffic Inspectorate, and licensing agency. The storage time must be at least 24 hours (for journeys under 500km) or 72 hours (for journeys over 500km).
Procedures for Registering a Freight Transport Business License
To obtain a freight transport business license, individuals and organizations must establish an enterprise, cooperative, or household business and register industry code 4933 – Road freight transport according to Appendix I of Decision 27/2018/QD-TTg.
Registration dossier includes:
- Enterprises, cooperatives: Application for a license; copies of diplomas and certificates of the person directly managing transport operations; copies or originals of the Establishment Decision and regulations on functions and tasks of the department managing and monitoring traffic safety conditions (applicable to certain types of transport).
- Household businesses: Application for a license; copy of the Business Registration Certificate.
Where to submit hồ sơ (dossier): Department of Transport of provinces or centrally-run cities. Submissions can be made directly or through the Online Public Services System.
Processing time: 05 working days from the date of receipt of a complete dossier. The time to notify amendments or supplements to the dossier is 03 days.
Fees: Decided by the Provincial People’s Committee.
